Court supports anti-social tenant’s eviction
A joint effort between Swan staff and residents helped secure the eviction of anuisance neighbour guilty of inflicting a campaign of ‘aggressive and abusive behaviour’ on fellow residents and Swan employees.
In a case that generated significant local media publicity, the Court of Appeal in London, rejected an appeal against eviction by Michael Morgan of Appleford Court, Basildon.
In total 13 allegations were proved against Morgan and the court upheld an earlier decision by Southend County Court to grant Swan a possession order.
During the case Swan worked closely with local residents to build a case against Morgan after repeated incidents including aggressive and abusive behaviour to residents and Swan staff and unacceptably loud music.
Residents and staff agreed that Morgan’s behaviour was not tolerable and decided to work together to monitor his unacceptable behaviour and report incidents.
Swan Neighbourhood Housing Officer, Mariea Davy, kept residents up-to-date on how the case was progressing and provided support to those willing to give evidence in court.
‘This case has been hard work, but the result was rewarding, as residents should not have to tolerate abuse from their neighbours,’ said Ms Davy. ‘I can sympathise with the residents as Mr Morgan was also abusive to me.’
One resident who acted as a witness during the court case said: ‘From what I have gathered from dealing with Swan throughout the whole situation, is that frontline staff are clearly dedicated, hard workers who show compassion.’
